If you believe material stored in BrassWell infringes a copyright you own or represent, write to us and a person will read it. This page explains what to send so we can act on it the first time.

What a notice needs to contain

These are the six elements U.S. law (17 U.S.C. §512(c)(3)(A)) asks for. A notice missing them is not necessarily ignored, but it is slower, because our first reply will be asking for them.

1. Signature
A physical or electronic signature of the copyright owner, or someone authorized to act for them.
2. The work
Identification of the copyrighted work you say has been infringed.If several works are covered by one notice, a representative list.
3. The material
Identification of the material you say is infringing, with enough detail for us to locate it.
4. Your contact details
Address, telephone number, and email address.
5. Good-faith statement
That you believe in good faith the use is not authorized by the copyright owner, its agent, or the law.
6. Accuracy statement
That the information is accurate, and — under penalty of perjury — that you are authorized to act for the copyright owner.
Please send notices in good faith. Under 17 U.S.C. §512(f), knowingly misrepresenting that material is infringing can make you liable for damages, including costs and legal fees. If you are not sure whether a use is authorized, ask a lawyer before sending a notice.

How BrassWell stores your material

Worth knowing before you write, because it often answers the question. BrassWell is a private ledger. Receipts, invoices, logos and documents are uploaded by a customer into their own account and are visible only to that customer. There is no public feed, no sharing between customers, no public profiles and nothing indexed by search engines. We do not monitor the contents of customer accounts.

If you have found BrassWell content published somewhere public, it was not published by us, and the site hosting it is the place to send your notice.

Counter-notices

If we remove or disable access to something of yours and you believe that was a mistake or a misidentification, write to support@brasswell.app. Tell us what was removed and where it was, that you consent to the jurisdiction of the federal court for your district (or, if you are outside the United States, any district in which we may be found), and include your name, address, telephone number and a statement under penalty of perjury that you believe in good faith the material was removed by mistake. We will pass a valid counter-notice to the complainant.

Repeat infringement

We terminate the accounts of customers who repeatedly infringe copyright, in appropriate circumstances. Termination means loss of access to the service; your data export rights are set out in our Terms of Service.
